Criminal law

Introduction

Criminal law, a branch of public law, is divided into substantive and procedural.

Substantive criminal law is a set of rules on the basis of which an action or an omission is characterized as a punishable offense (crime). Moreover, it determines the time and the type of the appropriate criminal sanction (punishment) to be imposed on the offender, either as a penalty or as a security measure. 

The law of criminal procedure establishes the rules that shall be respected and strictly implemented in the enforcement of substantive criminal law, as well as the role of state institutions therein.

The purpose of criminal law is to protect, on the one hand, the fundamental values of society, which are absolutely necessary for smooth and peaceful social coexistence, and, on the other hand, human rights and avoid state arbitrariness.
